Terms of Service
These Terms of Service ("Terms") govern your access to and use of OPTIMUS Signals ("OPTIMUS," "we," "us," or "our"), operated by Queylis Andujar / Optimus Signals LLC (Florida) and including the website at optimusalert.com, the Whop community at whop.com/optimus-signals, the Optimus Strategy TradingView indicator, and all related materials. By creating an account, starting a trial, subscribing, or using any part of the service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use OPTIMUS. By using the service, you represent that you meet this requirement, that you have the legal capacity to enter into this agreement, and that your use of OPTIMUS does not violate any applicable law in your jurisdiction. OPTIMUS is not available to residents of jurisdictions where its use would be unlawful.
2. Account & Access
Access to OPTIMUS Pro is granted through Whop. After subscribing, you must provide your TradingView username inside the Whop community Chat to receive Invite-only access to the Optimus Strategy on TradingView. Access is tied to the TradingView account you provide; you may not share, lend, transfer, resell, or otherwise distribute your access.
You are responsible for keeping your Whop, TradingView, and Tradovate account credentials secure. We are not liable for unauthorized access resulting from your failure to safeguard your credentials.
3. Subscription, Trial & Billing
- Trial: New members receive a 7-day free trial. No charge is made until the trial ends.
- Billing: After the trial, your payment method is charged $200 USD per month. Subscriptions renew automatically each month until canceled.
- Cancellation: You may cancel at any time from your Whop account. Cancellation stops future billing; it does not retroactively refund prior charges. Access continues until the end of the current paid period.
- Price changes: We may change pricing for future billing periods with at least 14 days' notice via email or in-product notification.
4. Refund Policy
No refunds. The 7-day free trial is provided specifically so you can evaluate OPTIMUS before any charge occurs. Because the trial removes financial risk during evaluation, all payments made after the trial period are final and non-refundable, except where required by applicable consumer protection law.
5. Intellectual Property
The Optimus Strategy, the underlying Pine Script source code, the Tradovate webhook integration logic, the website design, marketing copy, the Setup Guide, and all related materials are the exclusive property of OPTIMUS Signals / Queylis Andujar and are protected by U.S. and international copyright and trade secret law.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Optimus Strategy in your own TradingView account and execute it against your own Tradovate account, solely for personal trading, for the duration of your active subscription. You may not:
- Copy, decompile, reverse engineer, or attempt to access the Pine Script source code
- Share TradingView access with any other person
- Republish, redistribute, sell, sublicense, or rent the strategy or any derivative
- Use the strategy on accounts you do not personally own
- Use OPTIMUS branding, name, or materials without prior written consent
6. Acceptable Use
You agree not to:
- Use OPTIMUS for any unlawful purpose or in violation of any law or regulation
- Attempt to harm, disrupt, or interfere with the service or other users
- Harass, threaten, or abuse OPTIMUS staff or other community members in Whop Chat
- Attempt unauthorized access to OPTIMUS systems, accounts, or data
- Use the service in connection with money laundering, market manipulation, or fraud
7. Termination
We may suspend or terminate your access immediately, without refund, if you violate these Terms, attempt to share or pirate the strategy, abuse community members, or engage in any conduct we reasonably determine to be harmful to OPTIMUS or other users. Upon termination, TradingView access to the Optimus Strategy will be revoked and your Whop subscription will be canceled.
You may terminate your relationship with OPTIMUS at any time by canceling your subscription in Whop.
8. Disclaimer of Warranties
OPTIMUS is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the strategy will be profitable, that signals will be delivered without delay, or that the service will be free from errors or interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, OPTIMUS Signals, Queylis Andujar, and any affiliated parties shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to trading losses, missed profits, missed trades, lost data, account drawdown, or business interruption, arising out of or related to your use of the service — even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid OPTIMUS in the three (3) months immediately preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless OPTIMUS Signals, Queylis Andujar, and any affiliated parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the service, your trading activity, your violation of these Terms, or your violation of any rights of a third party.
11. Risk Disclaimer Incorporated
You acknowledge that you have read and agreed to the OPTIMUS Risk Disclaimer, which is incorporated into these Terms by reference. The Risk Disclaimer details the substantial risks involved in futures trading and the hypothetical nature of backtest performance.
12. Changes to These Terms
We may revise these Terms from time to time. The "Effective" date at the top of this page will reflect the latest revision. Material changes will be communicated by email or in-product notice at least 14 days before they take effect. Continued use of OPTIMUS after the effective date constitutes acceptance of the revised Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
